E-BOOK END-USER LICENSING AGREEMENT
My eBooks (aka “the Software Product”) and accompanying documentation are licensed and not sold. This Software Product is protected by copyright laws and treaties, as well as laws and treaties related to other forms of intellectual property. Labrys Press or its subsidiaries, affiliates, and suppliers (collectively “Labrys Press”) own intellectual property rights in the Software Product. The Licensee’s (“you” or “your”) license to download, use, copy, or change the Software Product is subject to these rights and to all the terms and conditions of this End User License Agreement (“Agreement”).
Acceptance
YOU ACCEPT AND AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT BY DOWNLOADING THE SOFTWARE PRODUCT OR BY INSTALLING, USING, OR COPYING THE SOFTWARE PRODUCT. YOU MUST AGREE TO ALL OF THE TERMS OF THIS AGREEMENT BEFORE YOU DOWNLOAD THE SOFTWARE PRODUCT. IF YOU DO NOT AGREE TO ALL OF THE TERMS OF THIS AGREEMENT, YOU MUST NOT INSTALL, USE, OR COPY THE SOFTWARE PRODUCT.
Respect for copyright
Using ebook PDF files in any manner other than as set forth in this Agreement without the express permission of Anne Frye and Labrys Press constitutes software piracy. It’s the same as coming by my table at a conference and taking a book, something you probably would never do. In order to make my books available in the most useable format, I am depending on you, my customers, to protect my copyrights and thus keep me in business. I appreciate your understanding and support. If you have somehow acquired a copy of one of my e-books that you did not pay for a license or subscription directly, it is an illegal copy. Call Labrys Press and pay for a license to bring yourself into compliance with this license or delete it from all your devices immediately.
Licensing Grant and Restrictions of Use
This license applies to the initial licensee and is not transferable (i.e., you cannot sell your license for an e-book to someone else). If the e-book is obtained as a gift, the link to download the e-book must be sent to the intended user. When you obtain a license you are granted permission to use the e-book within certain parameters, but you do not own the e-book in the same way you own a physical book. PDF formatted e-books are licensed for the personal and private use of the individual licensee. The file may be copied to up to four (4) of your personal computing/viewing devices for your use only. You may also save a copy as a backup to a flash drive or cloud service. This gives you access to the e-book in multiple locations and is the same as having four copies of a print-book. You can loan your viewing device on which the e-book is loaded to a friend, just as you might a print-book, but you cannot give her the file, nor can you buy a license together and each load it onto one of your personal viewing devices. Do not distribute or share the e-book in any other manner.
HiveCE is the only authorized source of access to Healing Passage for a subscription license. If you have subscribed to access an ebook online through HiveCE, do not share, sell or transfer your access log-in with anyone else in any manner.
Printing or copying from or editing the e-book is forbidden and the file is locked to prevent such use. If you are working in a partnership practice or an educational institution of any kind, the license is the same: the practice or school may buy and share the e-book on up to four non-networked devices owned by their business for use only by staff, but should, in every other manner, treat the software the same as they would a printed textbook. The ebook may not be installed on privately-owned devices by students or teachers. If the school licenses it, the school's devices should be used.
It is permissible to install the e-book on a new device and delete it from an older device to maintain the four-copy maximum.
Library Use
Libraries should license a separate copy of the book for patron use and are responsible for protecting the copyright permissions of all e-books. Libraries may use the ebook on only one (1) device unless other licensing arrangements are made. I recommend that the e-book be installed on a library computer and restrict viewing to only one terminal, permitting use as a reference text only since checking it out would require that it be loaned on a reading device and leave the file vulnerable to copying.
Inquiries about special licensing arrangements
To inquire about other licensing permissions, contact Labrys Press. Granting of permission and cost will depend on the use proposed. This Agreement does not permit the installation of the Software Product on more than two devices at any given time, on a system that allows shared use of applications (ie., not on a networked system), on a multi-user network, or on any configuration or system of computers that allows simultaneous multiple users. Multiple copy use or installation, other than as explicitly set forth here, is only allowed if you obtain an appropriate licensing agreement for each user and each copy of the Software Product. For further information regarding multiple copy licensing of the Software Product, please contact: Labrys Press, 7528 NE Oregon St., Portland, OR, 97213, www.midwiferybooks.com
Restrictions on Transfer
As a rule, you may not assign your rights and obligations under this Agreement, or redistribute, encumber, sell, rent, lease, sublicense, or otherwise transfer your rights to the Software Product. Requests involving exceptional circumstances may be addressed to Labrys Press.
Multiple Copy Use and Permissions
Specific multiple copy requests should be directed to Labrys Press. If you hold multiple, validly licensed copies, you may not use, copy, or install the Software Product on any system with more than the number of computers permitted by license, or permit the use, copying, or installation by more users, or on more computers than the number permitted by license.
Other Restrictions
You may not decompile, “reverse-engineer,” disassemble, or otherwise attempt to derive the source code for the Software Product. You may not use the database portion of the Software Product in connection with any software other than the Software Product.
HIGHLIGHTS OF THE E-BOOK AGREEMENT:
PDF formatted e-books are licensed for the personal and private use of the individual purchaser.
The file may be installed and read on a maximum of four (4) of your personal computing/electronic viewing devices that are intended for your personal and non-commercial use only. You may also make a separate backup copy of the file on a physical or cloud based storage device. This gives you access to the e-book in multiple locations and is the same as having four copies of a print-book.
Copies should otherwise be treated as you would any print-book. For example, you may load your pre-loaded device (such as an iPad) to someone just as you would loan a print book. Do not distribute or share the e-book in any other manner.
Printing or copying from the file is forbidden and the file is locked to prevent such use.
Bookmarking pages, searching the text, highlighting passages and inserting sticky notes are all allowed.
If you are working in a partnership practice or an educational institution of any kind, the practice or program may buy and share the e-book on up to two of their viewing devices at the same time.
It is permissible to install the e-book on a new device and delete it from an older device to maintain this two copy maximum.
Libraries should buy a separate copy of the book for patron use and are responsible for protecting the copyright permissions of all e-books.
I would recommend that the e-book be installed on a library computer for viewing as a reference text only since checking it out would require that it be loaned on a reading device and leave the file vulnerable to copying.
To inquire about other licensing permissions, contact Labrys Press. Granting of permission and cost will depend on the use proposed.
Using this PDF file in any manner other than as outlined here without the express permission of Anne Frye and Labrys Press constitutes software piracy.
In order to make my books available in the most useable format, I am depending on you, my customers, to protect my rights and thus keep me in business. I appreciate your understanding and support.
